This is an activity that is purposely done to misrepresent information on real estate documents. It also involves the money transfers. It is also called mortgage fraud. The reason that it is referred to as this is that the fraud generally takes place with the mortgage application. Real estate fraud, in the United States, can have heavy penalties like imprisonment and large fines.

Such a crime can be committed in many different ways. It appears to happen more often when property prices are on the rise. Because of the simplicity of the fraud, some types are seen more than other frauds. Some are not as common because they are more complicated. One of the common forms of such fraud, according to the IRS is preparing two settlement statement sets that are different from each other. In one of the statements, the accurate property-selling price is written, which the buyer receives. The other one will depict a higher selling price that is exaggerated. When the mortgage lender approves the loan for the exaggerated price, the seller is given the amount that is stated in their copy of the settlement statement. The one who committed the fraudulent settlement statements will keep the money that is left over. If there are other conspirators, the money will be divided among them. It could be the entire excess money or a percentage of it.

Using qualification that are fraudulent is another type of real estate fraud. These fraudulent qualifications are used when applying for a mortgage or home loan to help them get the mortgage. In this form of real estate fraud, the real estate agent will usually assist the buyer. The fraudulent qualifications can include fabricating credit reports or history of employment. These two involve the obvious misrepresentation of data but not all real estate fraud is easy to see as these two examples. If buyers who do not intend to commit real estate fraud because they do not know the laws can accidentally commit mortgage fraud.

If a buyer has a down payment by using money that was given as a gift it is legal. If this gift is re-paid to the who gave the gift, this is considered a case of real estate fraud. The gift used to make a down payment cannot be repaid for it to be legal. Another type of property fraud is when the buyer accidentally fails to disclose any financial liabilities on their mortgage application. It becomes fraud when it is not taken care of before the loan is approved. Property flipping can become real estate fraud if you make false representations about the value and condition of the property when you sell it for a much higher price than you paid for the property.

Upgrading the Radiator and Cooling Fan on a 1969 MGB Roadster

In all the 18+ years of ownership of our 1969 MGB Roadster it has never overheated, but a minor leak from the radiator in 2016 necessitated its change so I decided it was the right time to upgrade the cooling system in preparation for the next 18 years.

While checking on prices for a new radiator I came across a company in The Netherlands offering an aluminium radiator for not much more than a standard one, so ordering was a no brainer. Fortunately I ordered this about one month before the British voted to leave the EU and the Pound plummeted against the Euro.

As the whole cooling system had to come apart I thought I would also replace the engine driven radiator fan with an electric one. I have fitted Kenlowe fans to my cars in the past and while they worked perfectly well I had two issues with them. Firstly fitting with their universal fitting kit was never that accurate and always looked a bit untidy and secondly the sensor was an odd bulb arrangement which fitted in the head of the radiator and slotted into an extra seal, which I found difficult to make watertight.

This time I opted for a Revotec fan as it fixed both these problems. Each fan comes with a laser cut aluminium frame which fits onto long bolts in place of the normal ones and the sensor is embedded into a special section of aluminium tube which along with two short hoses replaces the normal convoluted top hose. The Revotec came complete with a good set of instructions and all necessary wires, connectors, and even a set of cable ties to tidy up the wiring.

Inevitably my work involved in replacing the cooling system doesn’t stop there as while this was removed from the engine compartment I cleaned it up as much as possible. The radiator surround and expansion tank, I had previously fitted, were removed and painted with black Smoothrite and the water pump hub in yellow. The inner wings were cleaned, a few areas touched in and all polished. I replaced the lower radiator hose, crankcase breather and oil cooler grommets at the same time while I had easy access.

Everything was installed relatively smoothly and with no problems. I wired in the fan and controller loosely to make sure everything worked properly, before I committed to cutting the wires to size and fixing it as tidily as possible.

The MGB all fired up first time and amazingly there were no leaks from anywhere. The controller worked well and after allowing the engine to heat up and the fan cut in OK. It took a few cycles to set it at about the right operating temperature. A good road test in varied conditions also proved successful, still without leaking. The Revotec works really well generating a huge airflow which cools the radiator very quickly and cuts in and out smoothly. My only criticism of Revotec is that nowhere in the instructions did it say what ampage fuse was needed to the fan supply. A quick Google search found this on the Revotec website. So why on earth don’t they include it in the printed instructions?

In theory removing the engine driven fan should also release a few extra bhp but no-one ever said how much. But as the MGB was originally only 95 bhp, and presumably over the years this has dropped a bit, even only a few bhp could make a 5% difference although there wasn’t any noticeable difference during my road test.

The new aluminium radiator and Revotec fan should serve the car well for a long time and it gave me the excuse to clean up the engine bay.

If anyone is injured, get medical help as soon as possible. Truth be told, calling 911 has the added benefit of documenting the incident for later insurance evaluation purposes. This is because the documentation generated from the call tends to indicate a propensity of a person being truly injured. While it may come across as callused, car accident cases – and other cases involving personal injury – are all about documentation.

Insurance claims representatives will even go so far as to reduce the value of a claim on not going to the emergency room, even if there are later objective findings indicating that an injury occurred. Injuries, such as cervical strain and sprain, tend to appear more than one to two days later after the “shot of adrenaline” wears off. However, it’s the documentation early on that is important.

Interaction With Law Enforcement

If police were summoned by a party contacting 911, documentation will again be generated. It is common that police, in addition to checking for injuries, may cite the at-fault driver for either a crime or a traffic infraction.

Keep in mind that a criminal case is the government (or, in Virginia, the “Commonwealth”) versus the defendant. A criminal case is about seeking justice. On the other hand, a personal injury case is about “being made whole again.” Until a magic wand is invented, that means the “bad guy” paying some form of compensation.

Before law enforcement makes a general “first look” at liability, they will gather evidence – including statements from other drivers and witnesses, as well as obtaining contact information. It is perfectly normal and expected for you to provide your insurance information to the other driver, even if they were at-fault. We highly recommend to clients not to make statements to the other driver’s insurance company. They’re frequently very motivated to assign blame to someone other than their own insured.

Don’t be limited in pictures of property damage of the vehicles. If it’s safe and prudent to do so, take copious amounts of pictures of you and your passenger’s injuries. This includes bruising that may later develop.

By being your own detective, the insurance company for the other driver may not be so quick to turn a blind eye to the blame of their insured. Documenting (if safe and not obstructive) while still at the scene to show the location of the impact, road conditions, and the condition of the vehicles may be critical bits of evidence later that a personal injury attorney can later utilize.

A good law firm will use this evidence to help develop your case into the best it can be under the facts. If you don’t have any of this evidence don’t worry. In most cases a client doesn’t provide this information during initial intake. That said, the more information provided the better.

Seek Medical Treatment

In line with the need to call 911, if necessary, is the simple fact that you need to seek medical treatment if you are hurt in the collision or later develop conditions that didn’t exist the day of the accident.

It is critical that you go to every appointment scheduled with a health provider and do everything that they tell you to do. Top in the playbook of every insurance company is to highlight any and all delays or gaps in treatment and try to use that information to diminish the value of your claim.

This is even true if you don’t have health insurance at the time of the collision. It is highly important that if you don’t have health insurance that you waste no time in getting it. In addition to being legally required at the time of this writing, health insurance may cover tens of thousands (if not millions) of dollars in treatments.

Even if you have the most amazing case, not having health insurance means that the proceeds of any later settlement or trial goes to pay the providers when it could have gone to your pain and suffering that you had to endure as a result of the injuries.

As a slight caveat, under some circumstances the insurance company for the other driver may reduce any settlement offer by the amount paid by insurance. However, this depends on the state and an entirely different analysis. You’ll need to consult with a car accident lawyer in your state to determine if this applies.

Avoid Waiting Until The Last Minute To Seek Necessary Medical Treatment Or Blowing Off Your Appointments If They Are Recommended By A Treating Healthcare Professional

Whether it’s the day after the accident and you were discharged from the Emergency Room or it’s month three of physical therapy or chiropractic care, you need to keep your appointments. We cannot stress this enough.

Car insurance companies for the other driver will even go so far as to unjustly say that you’re faking your injuries. They may resort to this accusation if you stop going to your appointments or blow off treatment all-together before it has run it’s course. Frequently, soft tissue injuries can “flare up” if maintenance treatments do not continue until their natural conclusion.

Once upon a time, it was a socially-acceptable attribute for people to be “tough” and “suck it up” despite pain. That doesn’t appear to be a common thread in today’s negotiations with insurance companies, especially when it comes to auto-injury cases. If you feel a certain way, pursue treatment. We recommend to clients to keep a daily pain and inconvenience journal, so we can see how they are progressing in their treatment.

Lawsuit Time: “Let’s Get It On!”

While this article was limited to what a victim of car accident can do to improve their case prior to their first legal consultation, I would be remiss if I did not include one final bit of information: choose an attorney that isn’t afraid of going to trial. If you don’t get the settlement offer that you are looking for (and is reasonable given prior settlements or verdicts), a knowledgeable Virginia car accident attorney would have no qualms about filing a lawsuit and making a request for appropriate damages to the judge or jury.

If, after negotiation with the insurance company and discussion with my client, we don’t get a settlement offer that is reasonable, then it may be time to file a lawsuit.

Occasionally, it may be advisable to cut the claims representatives out all together and file the lawsuit against the person that hurt you.

If the other driver’s insurance company doesn’t place the right value on your case, a jury of your peers may see that you internalized your pain, choosing not to be a burden on your family and friends, and assess damages a more reasonable way.

  • The relative assets and liabilities of the two spouses.
  • The property each spouse brought to the marriage.
  • The degree a spouse contributed as a homemaker.
  • The relative needs of the two spouses.
  • The marital misconduct of either of the spouses during the marriage.
  • The federal, state and local tax consequences of the alimony.
  • Whether the spouse seeking alimony lacks sufficient property to provide for their reasonable needs.
  • Whether the spouse seeking alimony is incapable of supporting themselves through appropriate employment.

Division of Assests

In Pennsylvania “marital property” means all property acquired by either party during the marriage and the increase in value of any non-marital property acquired. However, marital property does not include:

Veterans’ benefits exempt from attachment, levy or seizure pursuant to the act of September 2, 1958 (Public Law 85-857, 72 Stat. 1229), as amended, except for those benefits received by a veteran where the veteran has waived a portion of his military retirement pay in order to receive veterans’ compensation.

Property to the extent to which the property has been mortgaged or otherwise encumbered in good faith for value prior to the date of final separation.

Any payment received as a result of an award or settlement for any cause of action or claim which accrued prior to the marriage or after the date of final separation regardless of when the payment was received.

Property acquired prior to marriage or property acquired in exchange for property acquired prior to the marriage.

Property excluded by valid agreement of the parties entered into before, during or after the marriage.
Property acquired by gift, except between spouses, bequest, devise or descent or property acquired in exchange for such property.

Property acquired after final separation until the date of divorce, except for property acquired in exchange for marital assets.

Property which a party has sold, granted, conveyed or otherwise disposed of in good faith and for value prior to the date of final separation.

Pennsylvania states that the increase in value of any non-marital property acquired pursuant to subsection shall be measured from the date of marriage or later acquisition date to either the date of final separation or the date as close to the hearing on equitable distribution as possible, whichever date results in a lesser increase.

For tours, “single supplements” are generally added over the per person rate for pairs and couples. Lodging is less clear. What Indoor Rowing Taught Me About Food

When recently asked to discuss nutrition “worsts” for athletes, I zeroed in on one. But I think it applies to the holidays, too. Let’s take a look.

Taking an off-season with food is as energy-damaging as it gets.

My endurance coach, Jim Karanas, used to say, “Endurance athletes don’t mind expending energy, but they don’t want to waste it.”

Wasted energy is energy spent with no performance payoff. And the wasted energy of a food off-season is considerable:

  • It wastes physical energy for your body to deal with junky food.
  • It wastes time and energy to get things back on track for the next athletic season.
  • It wastes effort to correct bad habits, weight gain, mood swings, loss of motivation – and to re-create the right training state.

What stress on body and mind?

It reminds me of the terrible habits professional sports teams used to have when I was a kid. They’d actually stop all training during their off-season and then have to use the pre-season training period to get back in shape. Really. Think of the time, effort and money that took. Fortunately, pro athletes no longer do that.

But some non-pros may still do it with food.;

How Can Indoor Rowing Help with Food?

In the book The Stress of Life, Hans Selye defines stress as anything that takes the body out of homeostasis. If clean eating is your habit during your sport season – whatever that may be – then letting your nutrition slide is stress on your body.

And once you’ve established the new, junky pattern, shifting gears to get back to healthful habits again is additional stress on your body.

A few years ago, I learned a concept from the best rowing coach I know (and I’ve had several). Because he’s such a talented instructor and coach, he deserves a shout-out: Duncan Kennedy, who rowed with the U.S. national team from 1993 to 1994. He knows his stuff and loves to teach.

Duncan suggested that his indoor rowers use an outdoor rowing technique called Battle Paddle. In a crew boat, even during recovery moments, the rowers need to be in sync to prevent an 8-oar free-for-all.

So the strokes are just relaxed paddling, but the team stays in formation. Most importantly, the rowers are ready to drive into action as soon as they receive the signal. That vigilance underlies the relaxation at all times.

How about an athletic off-season that mirrors this concept with food – and becomes the nutrition equivalent of Battle Paddle?

Keep food intake – quantity and quality – under control, perhaps allowing an occasional dessert, say, once a week. From that point, driving into action for the next season will be a simple and disciplined matter.
